1.1 “Pockettpinch” refers to the marketplace platform, including its website, mobile applications, software, content, tools, and related services.
1.2 “User” refers to any individual or business that accesses, registers for, or uses Pockettpinch.
1.3 “License” refers to the limited rights granted to Users under this Agreement.
2.1 Pockettpinch grants each registered User a non-exclusive, non-transferable, revocable, and limited license to:
a. Access and use the Pockettpinch platform and services;
b. Upload content such as product listings, images, and descriptions;
c. Use seller or buyer tools provided by Pockettpinch to facilitate lawful transactions.
2.2 This license is granted solely for lawful personal or business use in accordance with applicable laws and Pockettpinch’s Terms & Conditions. It does not permit resale, sublicensing, framing, or commercial exploitation of the platform beyond its intended purpose.
Users shall not:
3.1 Copy, modify, distribute, translate, or reverse-engineer any part of the Pockettpinch platform;
3.2 Use the platform to promote, list, or sell prohibited products (as defined in the Terms & Conditions);
3.3 Interfere with or disrupt the operation, security, or performance of the platform;
3.4 Use automated scripts, bots, crawlers, or scraping tools without prior written consent from Pockettpinch;
3.5 Infringe or misuse Pockettpinch’s trademarks, copyrights, or proprietary systems.
4.1 All content, source code, designs, databases, and intellectual property related to the Pockettpinch platform are the sole property of Pockettpinch and are protected under Jamaican and international intellectual property laws.
4.2 This Agreement does not grant Users any ownership rights. All rights not expressly granted herein remain with Pockettpinch.
5.1 By uploading content (including product images, listings, and descriptions) to Pockettpinch, the User grants Pockettpinch a royalty-free, worldwide, non-exclusive license to:
a. Display, host, reproduce, and distribute the content on the Pockettpinch platform;
b. Use the content for promotional or marketing purposes related to Pockettpinch;
c. Share the content with third-party partners as necessary to facilitate transactions.
5.2 The User retains intellectual property ownership of uploaded content but represents and warrants that:
a. The content does not infringe any copyright, trademark, or third-party rights;
b. The content complies with all applicable laws.
6.1 Pockettpinch may suspend or revoke a User’s license, with or without notice, if:
a. The User violates this Agreement or the Terms & Conditions;
b. The account is used for illegal, fraudulent, or unethical activity;
c. Pockettpinch discontinues its services or platform features.
6.2 Upon termination, the User must cease all use of the platform. Pockettpinch may delete or restrict access to stored content or data, except as required by law.
7.1 The Pockettpinch platform is provided “as is” and “as available” without warranties of any kind, whether express or implied.
7.2 To the fullest extent permitted by law, Pockettpinch disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.1 To the maximum extent permitted by law, Pockettpinch shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to the use of the platform or this Agreement.
8.2 Pockettpinch’s total liability for any claim shall not exceed the greater of USD $100 or the amount paid by the User to Pockettpinch in the six (6) months preceding the claim.
This Agreement shall be governed by and interpreted in accordance with the laws of Jamaica. Any legal disputes shall be resolved under the exclusive jurisdiction of the Courts of Jamaica.
